This situation is a very common thing among students in Malaysia and also occurs among people who normally use more than one language. This phenomenon is called code-switching and usually happened in bilingual societies. What is code-switching? It is when a person mixes two languages in a single sentence or a conversation. This issue was ordinary to take place in Malaysian students which is learning more than one language. Our country students usually learned more than three language likes national language, mother language and etc. Our ministry of education set English as a second language in Malaysia, so Malaysian English Language Instructors and ESL (English as second Language) requires learners tend to use more than one code of language in the context of formal classroom. Now, we wants to discuss the factors that cause ESL learners to code switch and how to overcome it. 2.0 Main Body 2.1 Feel More Comfortable, Environment, Lack of Confidence The first factors it cause students cannot switching code immediately because they not usual to use English and also feel custom and more comfortable to use their own language. They prefer to use their own language because it is more smoothed and easy communicate with their friend. Besides that, they also did not have a good environment or social to speak English. Take one example, we was grow in a family which does not often speak English and we just only use our mother language to communicate with our family’s in home, that is a big problem for us to learn and speak English properly. The problem will cause the students lack of confidence to speak English because they do not have basic for speak to other people. Last but not least, they also will feel shy to use English because they are afraid of speaking mistakes. 2.2 Lack of Motivation, Lack of Interest, Lack of Enforcement Furthermore, they also lack of motivation because they do not get any courage from their friend or family. When students do not have enough vocabulary word they  cannot speak any perfects English. If they cannot speak English properly, they will give their friend laugh and it will causes they do not have more interest in English. Besides that, they will also give up to learn English and also will drop out of study. Motivation may be expect to improve when class take into account students likes in teaching style and lesson material. Additionally, parents did not enforce their children to speak and learn English in home. Parents also lack of accompany with their children to teach them important of English or another language in the whole world even tourism and doing business. 2.3 Watch more English videos, more interaction, talk with others race After the factors let us talk about solutions to overcome the problem students who are face it. Lecturers can takes some video from youtube or google to share with students but ensure the video can help students to improve their English. They can also listen music English or see an English movie to increase their listen and speaking skill. We must let students have more interaction and practice among them when during lesson. Lecturers should break them into different group with different language or country to get more chance to be in touch with English in class. 2.4 Join the activity can improve English, Attended to tuition, Penalty The parents need to speak with them in English and without home language at home to improve their basic in speaking. Parents also can send them to counselling or campaign for training them to use English in social life. Students must me hardworking and go to a place which availability of additional resources or knowledge to increase their vocabulary. To give those students cannot handle the basics English parents should force them to attend tuition class. When students in the school or college, lecturers must be ensure students are in the English speaking zone to communicate with their friend without other language. Last but not least, if those students who are not follow the rules must give a heavy penalty to let them remember and would not do a same mistake against. 3.0 Recommendation and Conclusion The use of mother language is not conclusively a threat to English as a language or a subject at school. In school or college lecturers should be concern about students have the ability to differentiate the two language and separate them in formal and non-formal communications in class.  Therefore, poor performance in English cannot blame on home language, but a person’s background. In my view educators should take the responsibility and teach suitable things to enable the primary level students learn in English. I can take an example that I will use software to supervise my homework and revision to ensure that I will not waste the precious time. 2.2 Replace Pen and Paper, Use To Memory, E-learning Apart from that, using cell phones to do home works or assignments can replace the pen and reduce the paper so that this will help to reduce deforestation as well as keep away from greenhouse effect. The cell phones can also become a â€Å"memory card†, when the student insufficient time to write down all the points that the lecturers given or he or she absents the lessons, they can just take a picture and do revision at home. Furthermore, they still can take out these pictures to revise before the examination. In this way it is killing two birds with one stone a stone. Additionally, they can use for E-learning in internet by using a cell phone with their friends and lectures to discuss homework or which are they do not understand in the lesson. 2.3 Distraction Class, Cheating, Bullying Every coin has two sides, cell phone also bring some disadvantages to us. An Examination of Music in The Tempest Compared to plays written for public playhouses, The Tempest offers a unique emphasis on music. Hiring extra musicians, along with the time constraints usually resulted in small attention given to this area (Long 95). Given the large degree of detail allotted to music in the play, it is believed the audience to have been upper class, however, music of The Tempest serves a variety of functions beyond that of mere entertainment. By exploring the evidence provided in The Tempest, we can reveal some of these functions that music serves in the play. Direct roles of music in The Tempest: Mental manipulation Music in The Tempest is utilized by Ariel to manipulate his victims in a number of ways, one being a sleight of mind. Take away the enchanted island and Prospero's magic and music still holds a quality which enhances or detracts from one's mood; similarly, Ariel's songs seem to have a way of creeping into the mind of the listeners, but his gradually changes their very thoughts. Our first evidence of how this manipulation functions is Ariel's song sung to Ferdinand: This music crept by me upon the waters, Allaying both their fury and my passion With its sweet air; thence I have follow'd it, Or it hath drawn me rather. Life vs Death: Euthanasia

The word euthanasia is of Greek origin, which literally translates to mean â€Å"happy or good death. † However, since the beginning of the 19th century, euthanasia has become associated with speeding up the process of dying or the destruction of so-called useless lives. No longer true to its literal meaning, it is now a practice of deliberating causing or assisting in someone†s death. Because it constitutes murder and is immoral, euthanasia should not be legalized in the United States. Almost everyone who attempts suicide or asks for assistance in their death do so as a subconscious cry for help (What†s Wrong With Making Assisting Suicide Legal? ). These people want to hear they are loved, not that someone is actually willing to assist in their death (Johansen). Many of these people have emotional and psychological pressures, which can cause them to choose euthanasia as a way to solve problems. Many are either depressed or dependent and are incapable of making well-informed decisions in that state of mind (Euthanasia:Answers to Frequently Asked Questions). The main concern for those who ask for euthanasia practice should be to give them emotional and spiritual support for their problems (Euthanasia : Answers To †¦ ). Tis type of counseling and assistance has proven to be successful. A study done on 886 people who had attempted suicide and been helped showed that only 3. 84 percent had gone on to kill themselves 5 years later. Another study showed that after 36 years, only 10. 9 percent had killed themselves (What†s Wrong With†¦ ). If euthanasia became legalized, it would be administered for those who are mentally unable to choose what is best, when they could instead be helped. Many who are in favor of euthanasia may say that a request to be killed is only justified when a doctor thinks a patient does not have a â€Å"worthwhile life† (Gormally). However, no one can judge the worth of a person†s life. â€Å"As a society, we are coming to understand that mere preservation of the flesh is not the highest value†. Many times it is the family of a patient who determines whether or not they live a worthwhile life depending on if they can participate in â€Å"normal† human relationships (Euthanasia Opposing Viewpoints 103, 117). Those who support euthanasia strongly believe everyone should have control over their own life and death and many who give â€Å"requests for euthanasia may indicate†¦ they are positively asserting their desire to control events† (The Case For†¦ ). However, the religious aspects to this issue support a different view. Religions such as Christianity, Judaism, and Islam hold life as sacred and believe it is a gift from God (â€Å"Euthanasia† Funk&Wagnalls). If the gift of life is from God, then only God can decide when that life should end, not someone else assisting in a death. Euthanasia is also considered immoral by these religions because the 10 commandments prohibit murder, which is essentially what euthanasia has become (â€Å"Euthanasia† Britannica). When many are suffering from a disease, they would rather die a dignified death than suffer tragically from the disease (The Case For Voluntary Euthanasia). Euthanasia activists claim euthanasia is â€Å"death with dignity†, even though the methods in which the deaths are carried out are anything but dignified. This can be supported by the euthanasia cases of Dr. Kevorkian, the â€Å"Doctor of Death† (Johansen). Dr. Kevorkian has used carbon monoxide to gas people to death, and has also had bodies dumped in empty vehicles in parking lots ( Euthanasia : Answers To†¦ ). Another example of how euthanasia killings are not dignified can be shown by the first televisioned mercy killing, which aired in March 1995 in Great Britain that caused the spark for the euthanasia controversy. The man who allowed cameras to be present at his death was a 63 year old patient of Motor Neurone Disease. Over 13 million people watched as he received a lethal injection by his doctor (Pratt). When these killings can be displayed for the public to see, they can not be considered dignified, especially by the means in which these deaths occur. If Euthanasia practices become legal, it would only legitimize these degrading practices. â€Å"Most elderly don†t fear death as much as they fear the pain and suffering†¦ † that may come along with it (Euthanasia Opposing Viewpoints 136). Because of this, some justify the euthanasia practice as a way to alleviate uncontrollable or intolerable pain that is placed on a patient. Even so, deaths by euthanasia are not always painless. Even a passive act of euthanasia such as the withdrawal of life support, food and water, can cause a slow and painful death (Euthanasia : Opposing Viewpoints 39). Death is also not the only solution for pain control. In fact, pain control has been perfected in the science fields, so that most pain can be eliminated completely or greatly reduced. Even though doctors are supposed to help control pain, many have never had a course in pain management and don†t know what to do (Euthanasia : Answers To†¦ ). Better education should be provided to health care professionals in order to help heal a patient, not harm them, or even kill them. Though euthanasia is illegal in most countries, where it is widely practiced, such as in the Netherlands, it has sometimes become involuntary on the side of the patient. Euthanasia is held accountable for 15 percent of deaths in the Netherlands, where patients actually fear being checked into hospitals (Johansen). Many times involuntary euthanasia occurs because the patient is incompetent to make decisions. Even though the patient may have written in advance a living will, a will in the United States that allows a person to make decisions on the type of treatments they would want if they were ill, a proxy can override these decisions. A proxy is usually a relative or friend of the patient that can make decisions for them if they are incapable of communicating on their own. This person could then cause the death of a patient, even if it is a passive act of euthanasia which is not doing something that is necessary to keep a person alive (Pratt). If euthanasia were practiced legally in the United States, it would become involuntary to the patient and possibly cause a larger percentage of deaths than it already does, as it has in the Netherlands where it is commonly practiced. It is also said that euthanasia would be for those dying from an incurable disease or intolerable suffering (â€Å"Euthanasia† Funk&Wagnalls). However, there is no real definition for an incurable or terminal disease, especially since modern medicine has lengthened life spans. Some say a terminal disease is a disease that can cause a death within 6 months, while some who are claimed to be terminally ill may not die for several years (Euthanasia : Answers To†¦ ). In 1976, the New Jersey Supreme Court gave permission to the parents of comatose Karen Ann Quinlan to remove her from the respirator that was keeping her alive. Even though she was expected to die immediately, she began to breathe on her own and lived another 9 years (Euthanasia : Opposing Viewpoints). Because of cases such as this that show fault in the definition for terminally ill, euthanasia activists change the term terminally ill to hopelessly ill or desperately ill. The definition used for hopeless condition includes those with physical or psychological pain, physical or mental deterioration, or a quality of life unacceptable to the patient (Euthanasia : Answers To†¦ ). With such broad definitions for the term, hopelessly ill could include mostly everyone. The legalization of euthanasia would entirely contradict the medical practices that were established in the Hippocratic Oath, an oath over 2500 years old. Medical students, upon completion of medical school, must vow : I will use treatment to help the sick according to my ability and judgement, but never with a view to injury and wrongdoing. Neither will I administer poison to anybody and when asked to do so, nor will I suggest such a course (Euthanasia Opposing Viewpoints 97). Even though neither the laws nor medical ethics say everything should be done to keep a person alive, the oath forces medical professionals to make a promise to help the sick (Maier). Doctors should be highly enough educated in order to make the best decision for each individual patient. Even if a person requests assistance in their death, it does not give the doctor enough reason to say euthanasia would be the best choice for that patient (Gormally). â€Å"Poisons†, as stated in the Hippocratic Oath, are not to be administered even though many mercy killings now are committed with â€Å"double effect. These are high doses of medicine that may kill a person faster (The Case for†¦ ). A high dose of a medicine is as much of a â€Å"poison† to a body as carbon monoxide, another means of carrying out the death, is. If euthanasia became accepted in the medical professions, it would be an immoral practice that would contradict its origins. For those who are pro-euthanasia, the laws pertaining to euthanasia are considered to be government mandated suffering. The other side to this argument is that these laws are not intended to make anyone suffer, but are instead created to prevent abuse and protect patients from bad doctors (Euthanasia :Answers To†¦ ). There is no actual provision in the legal systems for euthanasia. It is either considered murder or suicide in the United States (â€Å"Euthanasia† Brittanica). It can be a tough situation because on one hand doctors who force treatment against wishes can be charged with assault (Pratt), while if nothing is done to prolong life or if life-support is withdrawn, criminal charges can be also be brought on (â€Å"Euthanasia† Britannica). In the Netherlands, doctors can assist in a euthanasia death even though it is illegal without the possibility of prosecution and there, euthanasia has become out of hand (Pratt). With the legalization of euthanasia in the U. S. , laws and policies would be changed so that rights that would be given to others in order to intentionally cause the end of a life (Euthanasia :Answers To†¦ ). It would become an uncontrollable practice. Instead of legalization, laws on euthanasia should become stricter. Euthanasia has become a problem in the United States that would only become worse if it were legalized. Legalization of euthanasia can not be justified when there is no real determination for the definitions of many terms that play a major role in the euthanasia issue. The practice of euthanasia also carries out undignified deaths that are immoral. It has no benefit to the medical society and contradicts all medical ethics. Assisted suicide has also become involuntary, unsuccessful, and uncontrollable in other countries. For these many reasons, euthanasia should not become legal in the United States.

The aims and nature of ryanair

The aims and nature of ryanair The aims of this report are to analyse and explain the nature of Ryanair business organisation, identify the contribution of functional areas to the operation of Ryanair organisation and to demonstrate an understanding of core concepts in functional areas. The objective of this report is to show understanding in organisations key areas such as: organisational type, financial information, marketing management, quality and supply chain. The Ryanair Holdings second-largest airline in Europe in terms of passenger numbers came to the business world in July 1985 with flights on a 15-seater Bandeirante aircraft. It was operating daily from Ireland to London Gatwick airport. Quantity of passengers was approximately 5,000 thousands. In 2009 quantity of passengers increased by 66,503,999 million. Ryanairs fleet rose to 232 Boeing 737-800. During 1985-2009 Ryanair has opened bases in the centre and north side of Europe. Low cost airline profits rose 200% to over 318 million euro while many of Ryanairs competitors announce losses and even more go bankrupt (Ryanair 2009). Ryanairs future activities will be considered in below presented articles. 2.0. Findings Figure 1. Ryanair Holdings Logo (Ryanair 2010) 2.1. Organisational Structure Bonderman and OLeary (1996) established a new company Ryanair Holdings, they have bought the control of Ryanair Company just for  £5 million cash, an airline they had valued at approximately  £57 million. From that moment Michael OLeary is Ryanair Holdings legal entity (Creaton 2007:117). 2.1.1. Sector in which Ryanair Trade According to Palmer et al., Ryanair operates in private-sector, because the aim of private-sector organisations is to earn profits for the owners of the organisation. As OLeary is entity of Ryanair, he: à ¢Ã¢â€š ¬Ã‚ ¦always acting in the interests of the company because he is a shareholder (Siobhan Creaton 2007:278). Moreover, OLeary said that he will earn as much profit as he cans (Siobhan Creaton 2007:277). In addition, private-sector is able to monitor the results of its marketing activity, as the benefits are usually internal to the organisation (Palmer and Hartley 2006:230). Ryanair publish their annual report which will be used in this report as an example of sources of finance (Ryanair Holdings 2010). Private sector is subdivided into four types, but Ryanair refers to two of them: Private Limited Company (LTD) and Public Limited Company. LTD permits some defence to the shareholders they take a risk to invest money for business. Thus, shareholders can use Ryanairs annual report (Ryanair Holding 2010) which includes detailed financial information (Boddy 2002:488). PLC must have a minimum share capital of  £50,000 and must have at least two directors. As to Ryanair, OLeary and Bonderman have bought control over Ryanair Limited for  £5 million (Palmer et al. 2006:220). Consequently, Ryanair Holdings PLC (Ryanair Holdings) is the holding company for Ryanair Limited (Ryanair). 2.1.2. Structural Style Ryanairs structural style is divisional, where administrators create divisions and make them responsible for all the functions to deliver their facilities to the consumers (Boddy 2002:245). Ryanair Company has geographic divisions, to the location of customers. For example, Ryanair has a group of people who works in Baltic countries, such as Latvia and Lithuania and there are managers, who are responsible for staff, customer needs, and manager use autonomy to meet local needs (Boddy 2002:246). 2.2. Ryanairs Source of Finance Ryanairs company is financed by internal sources sources of finance that come from the business activities retained profit. For example, if the Ryanair business had a successful trading year, the organisation can use got profit for future activities. Of course, Ryanair can use profit only after paying all its costs (Manak 2009:184-185). The advantage is that source is very useful for long term business, because they can use it sources for future business activities. For example, Ryanairs attendants sell a variety of products such as MP3 players, digital cameras, perfumes and so on. All the extras revenues are up to 15% of all revenues. Ryanair Company is trying to earn revenue on everything on the board except seats (Kotler et al. 2009:577). Furthermore, Ryanair is run by equity finance. That means that organisation or a person providing money, does not receive interest and there is no guaranty that it will be repaid. If organisation had a success in borrowing money there will be an increase in share value or in dividends. Besides, after borrowing success, shares could be sold to some on else. (Smith 2007:291). There are different types of shares: ordinary shares and preference shares. Ryanairs organisation has ordinary shares. Shareholders receive ownership of a small part of a business and they carry complete voting rights. The number of ordinary shares that Ryanair has is 1,476.4 (in Ms) (Ryanair Holdings 2010:138). Correspondingly, companys earnings per ordinary shares are 20.68 (euro cent). However, if organisation will have unsuccessfulness, shareholders will be last people who will receive proceeds and may be receive nothing at all. (Smith 2007:292). 2.2.1. Profit or Loss? Being based on Ryanairs Income statement for year 2010 company got the profit of à ¢Ã¢â‚¬Å¡Ã‚ ¬341million before tax and à ¢Ã¢â‚¬Å¡Ã‚ ¬305.3 million after tax (RH 2010:135). Thanks to lower oil prices, companys traffic increased to 14% of customers. Ryanairs non-ticket revenues rose to à ¢Ã¢â‚¬Å¡Ã‚ ¬661 million or 11% in 2009 but now (2010) account is 22%. Besides, Ryanair opened 280 new routes in 2009, with destinations such as Spain and Portugal for summer travellers, making higher summer rates. Besides, shareholders will receive special dividends up to 550 million euros. Congruently, Ryanairs chief executive OLeary will receive 20 million euros, who owns just 4$of the companys shares. (Guardian 2010) 2.3. Marketing strategy and Target Market Marketing strategy: à ¢Ã¢â€š ¬Ã‚ ¦involves the activities of selecting and describing one or more target marketsà ¢Ã¢â€š ¬Ã‚ ¦ (Lamb et al. 2008:43). To identify target market, an organisation should identify which of the segmentation is distinct and actionable. Ryanairs target is market segmentation activity. Segmenting market relies on detecting the variables that differentiate customers with need (Boddy 2002:215). Ryanair organisation refers to demographic segmentation social class. It can be used characterised function standards such as education, profession and property worth (Kotler 2009:16). Company select only one target segment to focus on, consequently, organisation use concentrated targeting strategy. The advantage is that business may concentrate on resources and can better meet the needs of defined segment (Lamb et al. 2008:247). 2.3.1. Marketing Mix When target market is identified organisation can evaluate marketing mix. McCartneys four marketing mix tools were expanded to 7Ps by Boden, which had a more services focus and included process, physical evidence and people. 7Ps is a necessary mix that company should track to maximise marketplace results (Kotler et al. 2009:17).Ryanair is using 7P Formula for its brand image, which consists of: 2.4. Quality Strategy According to David Garvin (1981) there are 8 dimensions of quality that can serve as a quality framework. For Ryanairs Company quality strategy identification we will use only 4 the most obvious dimensions: Performance characteristics of a service (Garvin 1987:50). For example, Ryanairs service speed, flight booking is depended on your own, because Ryanair is offering only self-service. Another example is absence of waiting, unfortunately, Ryanair not the best in this service, because flights are usually delayed. Perceived quality -it is about clients previous experience, what he thinks about that company (image, reputation) (Garvin 1987:59-60). Focussing on core brand value (providing cheap tickets to approximately 49 million passengers who desire low cost to high service) is a key of Ryanairs success. (Kotler et al. 2009:443). Aesthetics it is about personal judgment of individual (Garvin 1987:59). For example, passenger is ordering some food that looks and tastes not as good as at picture was. In addition, sight or vision of service. For example, Air France KLM have an impression of luxury thanks to leather seats, while Ryanair has plastic seats with blue and yellow as the dominant colours of no frill focus company (Kotler et al. 2009:681). Serviceability how fast client will be served (Garvin 1987:57). For example, passenger is ordering some meal and he gives denomination but not a coins, it will take an eternity to receive back your change. So Ryanair has very poor serviceability. Relying on above mentioned facts it is possible to tell that Ryanair has not got any strategic quality at all. Ryanairs chief executive is obsessed with providing a functioning airline and cared little about pleasing its passengers, passengers number growth and companys profit (Creaton 2007:271). 2.4.1. 3 Key Areas of Quality Quality Service People Marketing High (Service satisfies customers needs) Sales promotion Low (customers are dissatisfied) Food for extra pay; Uncomfortable seats; Checked luggage; Bus transportation into town. Employees must pay for own security checks Staff must pay for own uniforms and parking Staff must supply own tea and water Advertising Service is an indicator of poor quality, because while you are flying at Ryanair aircraft you will not receive any food for free. For example, the hot dog for 4 euros (Kotler et al. 2009:577). Moreover, it is well known fact, that Ryanairs seats are uncomfortable, seats do not recline and seat-back pockets have been removed (Kotler et al. 2009:577). Comparing British Airways (BA) with Ryanair, BA has first business and economy classes seats, while Ryanair has only Economy class seats (British Airways 2011). Furthermore, client should spent extra money for bus or train transportation into town from distant airports that Ryanair uses (Kotler et al. 2009:577). Furthermore, Ryanair has poor quality in HRM. Staff could no longer enjoy their tea or coffee for free, staff must to bring own drinks and snacks to work. Cabin crew were banned to use ovens on board, because there will be no additional cleaning costs. Pilots were told that they can use only one ream of paper a day (for reports). They also have to do bi-annual medical examinations, in their own time, and what is the worst they have to pay for their own for it. Additionally, reduction concerns to uniforms, company will deduct monthly sum from staff pay to cover their uniforms. Besides, there is a problem of absenteeism in Ryanairs company (have lost over 10,000 days) (Creaton 2007:239). Ryanair is famous with rude and scandalous posters. One of the examples is poster which offended BAs company (Creaton 2007:239). Comparing Ryanairs posters with BAs we can say that BAs advertising is more enjoyable, because there are no slogans that are concerned with price reduction (see Appendix 1 and 2). The only thing that has a high quality is sales promotion; because a quarter of seats are free, passengers pay only taxes and fees of approximately 7 16 euros (Kotler et al. 2009:577). In addition, buying a ticket passenger can return their 10 pounds, receiving a coupon (after completing online booking Ryanair offer to complete form). 2.5. Sequence of Supply Chain Activities Ryanair Company provides transaction by airplane services. The table below shows the sequence of supply chain activities. At First, passengers decide to use Ryanairs airline then they have to complete the online form at Ryanair.com, then passengers will receive digital receipt at their e-mails. The following stage is online check-in, which you must to complete from 15 days up to 4 hours prior to passengers scheduled flight departure. Moreover, client must to print check in ticket. The disadvantage of Ryanairs Supply Chain service output is waiting time. It is the time that customer has to wait before flight. The lower the waiting time, the higher the level of service (Bowersox et al. 2010:51). For example, Ryanairs flights are often delayed and sometime even cancelled. Consequently, Ryanairs level of service is poor. 2.5.1. Value -Added Services Ryanairs internet booking is the value-added service in Supply Chain process. According to Bowersox (2010) et al. value-added services refer to unique activities that firms can develop to increase their productivity. For example, internet booking is unique activity, and passengers, buying tickets, online can save they time. In addition, online check-in is value added service, because if passenger does not have luggage (more than 15 Kg) he can go straight to the gate. Online check-in helps to save passengers time (do not wasting time staying in the registration queue) and companys time and money (staff working hours). The company is in great demand at consumers despite that consumers are performing self-service, of course except transaction by airplane. People are ready to for this kind of services, because they prefer low cost rather than high quality or supply chain services. Ryanair is offering close distance only that is why consumers prefer low cost ticket, 2 or 4 hours may not cost a high quality. 3.0. Conclusion The main conclusion that can be drawn therefore is that: 1. Ryanair organisation is trading in the public sector that gives an advantage for its owners, because private sector helps to earn money for them. Also, Ryanair adopted divisional structure, because airline has it offices almost in all over Europe. 2. Ryanair is run by retained profit and equity finance. Furthermore, company is making profit of à ¢Ã¢â‚¬Å¡Ã‚ ¬341m before tax. 3. Ryanairs target market is demographic segmentation if speak in detail Ryanair company is considering social class for characterising function standards such as education, profession and property worth. Ryanair is using Seven P Formula as a marketing mix for its brand image. 4. Quality dimensions speak about that Ryanair business organisation has got a poor quality. 3 key elements: people, service and marketing -are not high quality. The only thing that is high quality is Ryanairs sales promotion. 5. Almost all the Ryanairs services are self-services, except transaction by airplane. Correspondingly, Ryanairs supply chain has disadvantage such as service waiting time and supply chains poor quality. Ryanairs trading in the last 5 years are talking that organisation had pick moments and also had some falls. Generally, company had shown excellent performance in low-cost strategy, increasing it passenger number from 34.8 million (2005) to 66.5 million (2009), while many of Ryanairs competitors announce losses and even more go bankrupt. During 5 years Ryanair has opened bases several new bases such as Bournemouth, Birmingham and Belfast. Forecasting how the Ryanair business may proceed in the current economic climate, I may say that Ryanair will continue to exist in the world market, because its chief executive knows what people want low cost tickets. Consumers interest in traveling will continue to exist even in economic recession time. While consumers incomes are falling but supply is increasing, Ryanairs organisation will continue to offer low cost seats or even seats for free. I assume that in future Ryanair will expand it destinations to other continents such as South America and Africa, because company has got huge possibilities for that. The only thing to do is to find additional investors and to think over the strategic plan. 4.0. Recommendations In the light of these conclusions, I would recommend Ryanair organisation to improve organisations supply chain. All the Ryanairs destinations are operating into far-flung airports and passengers are confused about airports. All that it is necessary is change some of the destinations to major cities. Another solution is to write not only the airports name and country but write a citys name as well. In addition, I would recommend to improve quality strategy a specially one of the quality aspects people (HRM) as staff may start to strike. Their needs are not considered, company should prove such necessary elements such as uniforms and bi-annual medical examination. Of course, it will cost huge amount of money for the organisation but still staff will be satisfied. As a consequence, staff will work better and Ryanairs service will be little improved as well. Dough Writing :: Writing Technology Inventing Essays

Dough Writing Writing, to many, is not seen as a technology. This everyday, innate, task is easily over looked especially in today’s modern world of high tech computers, cameras, phones, and palm pilots. It’s hard to imagine at one time people actually invented this thing called the alphabet, somehow made each letter represent a certain sound, then by combining this with other letters and sounds made words. But someone did and we, as a society, forget that and take writing for granted. We do not think about writing or its intricacies when we are in the act of writing. This is partially due to the availability of writing utensils and other materials needed to perform the task. What happens though when those things are taken away from us? Set about with this task, to write something without using any form of writing technology including pencils, pens, paintbrushes, and paper, I have found a new respect for writing, and the tools used to write with. I saw this as the intended outcome, but what surprised me was the amount of thought and planning the writing took. Not thinking of what to write, but instead how to write it, not with which materials, but how to actually shape the letters to make them legible. Once given this assignment I began thinking about nature and came up with my first course of action: a piece of bark with carbon writing on it from a burnt stick. This sounded great, how easy, then I realized I live in an apartment with no trees around. I thought about going to my friends and taking materials from their trees but when I tried the snow and rain from the past week had made everything very wet and hard to work with. The bark was too moldy or malleable and the sticks were too damp to light on fire. I had to find another way. My next idea was to make paper and write with charcoal or carbon on that. I had done this before in elementary school and remembered it to be quite easy. We had made a lot of paper for nature journals so I felt it appropriate for this assignment. I had everything ready to go, the blender, berries to make the paper pretty, water, flour, and a stick.

Developments between 1860 and 1877 Essay

In 1861 the bloodiest and one of the most important revolutions in American History began, The Civil War. Socially this war had been brewing since the beginning of slavery. This controversial subject had been the object of debate mainly because it required a balance between free and slave states. Slavery was also a big issue between the Democrats in the 1860 election because they could not agree on the issue of popular sovereignty. This eventually led to their splitting which opened up the doors for Lincoln to take office. After Lincoln was inaugurated in 1860 seven states ceded and later four more. The south believed they were within their constitutional right to cede. In South Carolina’s Declaration of Causes for Session the state says, â€Å"Powers not delegated to the United States by the constitution†¦are reserved to the states (Doc A).† This leaves Lincoln at a quandary over the age old constitutional issue of Nullification and session debated back in the day of the Virginia Kentucky resolutions and Hartford Convention. He resolves that it is not within the states power to cede and brings the nation to war. The eventual victory for the North would bring about one of the greatest changes in history; the Emancipation Proclamation that forever ended slavery and changed the southern way of life. With Slavery no more and a Southern society in ruins more changes had to be made in the Reconstruction revolution. After Lincoln’s and Johnson’s plans for reconstruction failed, the Republicans who now controlled congress took the reigns. Socially there was the large issue of all these freedmen with nowhere to go, who are now demanding equality. In a petition written just after the war in 1865 from African Americans to the Tennessee Convention the blacks say, â€Å"If we are called to military duty†¦should we be denied the right to vote (Doc C).† That same year a letter to the Freedmen’s Bureau (a group dedicated to helping protect blacks and their rights), from a group of blacks was asking for homesteads so they may have the same rights as white land owners (Doc E). With the need to help these newly freed blacks and protect them from those endorsing things like the Black Codes, states had to develop a constitution with special specifications to black’s rights. The constitutional changes that occurred not only to the state governments but to the national governments as well were the thirteenth amendment that ended slavery, the fourteenth that made blacks citizens, and the fifteenth that gave blacks the right to vote as illustrated in The First Vote (Doc G). The latter developments changed the south and America forever. The entire southern way of life was flipped upside down economically and socially. Sharecropping and the crop-lien system emerged to solve the labor shortages, blacks status increased, and education expanded; these are some of the main results of the Reconstruction Revolution. The Final revolution of this time unfortunately was that of the Redeemers. Since the beginning the conservatives had been fighting reconstruction in the South. The South had always had people (the democrats) opposed to black suffrage. Gideon Wells said, â€Å"The Federal government has no right†¦to dictate the matter of suffrage (Doc D).† To resolve these conservatives would require literacy tests to vote, and reinstate property requirements. These methods were ways around the vague constitutional developments of the 15th amendment. Violence was also used as a means to control the black population in the South. The Klu Klux Klan and White League would use terrorist acts on blacks and lynch many innocent blacks to discourage them from voting as illustrated in (Doc I). Blacks were also segregated from whites, which after the Supreme Court case of Plessy v. Ferguson was deemed legal as long as they had equal opportunities; however, the blacks did not have equal opportunities but it still allowed the whites to avoid the 14th amendment. Finally, in the Compromise of 1877 Rutherford B. Hayes was elected president and withdrew the troops from the south. The north believed that with the vote the blacks could take care of themselves and they also had their eyes focused on the West. However, with the soldiers gone the blacks became once again subject to the will of the whites. This is where history is debated on whether reconstruction was a success because the Redeemer revolution reverted the south back to a segregated area of tension once again. The faà §ade that was America changed significantly from 1860 to 1877. The constitution had been written a century prior leaving out many key issues. To address these issues revolutions took place and in the end change was made. The debate over slavery and cession led to finally freeing those who never deserved oppression. The end of the Civil War brought about the need for black rights and new ways of life. Opposition to these revolutions led to the reverting revolution that turned back the clock taking away once again what so many died for. The social and constitutional developments that helped fuel these revolutions are responsible for some of the nation’s greatest achievements like the 13th, 14th, and 15th amendments, and some of the worst like segregation.

These factors make up some of the major key selection criterias international shipping companies consider when selecting a transshipment port. With that in mind we the ow ners and managers at ARJ Container Terminal will be trying to attract carriers with our automating handling equipment, the speeding up various services, and providing the most current information on the ? w of containers. At the same time, however, we will reduce costs by utilizing our resources e? ciently, including human resources, berths, container, yards, quay cranes, and various yard equipment. Our key and optimum advantage will be our location. This location in Little Bay, Little London Westmorland Jamaica West Indies will have the sufficient harbor water depth and dock space that will make it possible to facilitate docking of up to a Super-Panamax vessel.Dredging will not be required to accommodate these large draft vessels, hence no disturbance or depletion of any marine wildlife sanctuaries on the harbour floor or natural habitat will be caused. We and our management team are greatly pleased by this because outside of us wanting to create an optimal high efficiency containe r terminal, we also want to know that it is done with little or no impact on the surrounding environment and wildlife. ARJ Container Terminal location will be 25 minutes from the capital city of Savanna La Mar and 5 minutes from the A2 South Coast Highway.This will aid greatly in our multimodal transportation planning for both our clients and ourselves and also compliment positively on the domestic distribution side of our company. We are a limited liability company that specialises in container and general cargo handling for transshipment and domestic purposes. The company is owned by Shiek Revalino Bennet, Shiek Andre Gibson and Shiek Jenoir Dick and is manage by our seniors directors Oshane Polson, Tandra Morris and Jodian Braham The objective of ARJ is to provide integrated cargo service solutions for shipping companies worldwide.Due to our highly competent managers, the company will be able to substantially increase its cargo turnover and ensure regular cargo flow, and to compl iment our effectiveness we will be the only terminal on the island of Jamaica with Sea-Rail transshipment operations. This will enhance our domestic function and in turn bringing first class service to the developing nation of Jamaica. Our developed terminal infrastructure, cargo handling technologies and modern equipment will definitely ensure ARJ’s competitiveness and peak position in the transit market.We will offer value-added services including customs operations, freight forwarding and logistics solutions so this can basically be a one stop shop for our customers/clients. ARJ will employ 111 qualified specialists in different fields to ensure the company’s operational efficiency and productivity level is on par with the major terminals around the world and even exceed if possible. We are predicting from global feedback that our total container flow for 2013 will be approximately 750,000 TEU. ARJ Air Layout Infrastructure: Berth: Length – 290 m Draught â₠¬â€œ 15 m Warehouse area: 16,310 m2Open-air storage area: 120,800 m2 Technical equipment: Quay cranes at the vessel: – STS crane – Conventional quay crane – Mobile harbor crane For container transfer (horizontal transport): – SC (max. stacking capability: 1-over-3-high) – Reachstacker – Terminal tractor with trailer (so-called Tractor-Trailer Unit (TTU)) – Multi-trailer (terminal tractors with several trailers) – Empty/loaded container handler – Shuttle Carrier (ShC stacking capability: 1-over-1-high) – Automated Guided Vehicles (AGV) – Automated SC (max. stacking capability: 1-over-2-high) For container transport and stacking within the yard: SC – Rubber-Tyred Gantry crane (RTG crane) – Rail-Mounted Gantry crane (RMG crane) – Container handler (like reachstacker or top lifter) – OverHead Bridge crane (OHB crane) For the landside operation: – SC – RTG crane – RMG crane – Reachstacker – TTU At the inland navigation vessel: – STS crane – Conventional quay crane – Mobile harbor crane The STS crane drops down containers on TTU that will transport the containers to the stacking area where the boxes are stacked by reach stackers (see Figure 1. 1) or forklift trucks fitted with appropriate spreader frames for container top or side lifting.Due to their versatility in operation, reach stackers are the best choice for our multi-purpose terminal as they are easy to handle, can be used for stacking in the yard, loading and unloading of TTUs, road trucks and rail cars on first rail. Including our landside operation, an estimate of 3–4 reachstackers and 4–5 TTUs are required per STS crane. The specific number of TTUs in particular will depend on the distance between the berth and the stacking area of the respective operation. The TTUs are used for the transport of the containers between the vessel and the container yard.Figure 1. 1- Reachstackers and TTU operation A storage capacity of approx. 350 TEU per hectare for 3-high stacking and 500 TEU per hectare for 4-high stacking are common figures for our type of yard equipment. The maximum stacking height is 5, container blocks can be kept 4-deep due to second row access. In case of relocation of capacities reachstackers are easily transported to another terminal or used for other cargo handling and because of their easy transportation between terminals reachstackers can be used to cover temporary requirements. Straddle Carrier System:The STS crane will place containers onto the apron from where the SCs transport them to the stacking yard (see Figure 1. 2 and Figure 1. 3) and stack the containers. The SCs are independent from any other equipment and are able to perform all the different handling operations: transport, stacking and the loading/unloading of trucks and rail cars (see Figure 1. 3). SC systems are the optimal system for large size terminals when high flexibility in the yard and accessibility of the boxes are required and thay make it easy to alter the layout of the terminal.A storage capacity of approx. 500 TEU per hectare stacking 2-high (3-high SC) and 750 TEU per hectare stacking 3-high (4-high SC) can be achieved. The maximum stacking height is 4-high. Including landside operation, an estimate of 4–5 SCs are required per STS crane – without considering specific conditions. The system will be supported by container handlers stacking MT boxes and/or RMGs for container handling in the rail yard. This kind of container handover enables STS cranes to operate with a high productivity while using a comparatively low number of SCs per crane. high number of concurrent container movements †¢ the breakdown of one SC has a comparatively low impact on the total handling process †¢ compared to the systems with TTUs the labor costs are lower due to the smaller number of vehicles †¢ no disturbance of the operation by trucks because these are loaded/unloaded outside the stacking yard †¢ the system is flexible to changes based on operational requirements and terminal layouts can be simply altered as SCs can be easily moved within the terminal since no pre-set routes or tracks are needed Rubber-Tyred Gantry Crane System with Tractor-Trailer UnitsThe STS gantry crane places the container on a TTU unit that transports the container to the storage area where the RTG crane stacks the containers in long blocks (see Figure 1. 4). The RTG can be used for TTUs and road trucks as well. The size and structure of the RTG crane is determined according to the requirements of the terminal operator. The system has a very high stacking density because of the high stacking capability and the block stacking. Long traveling distances on the terminal are less problematic as TTUs transport the containers.RTG cranes will also be effectively used for the handling of containers on road trucks or rail cars. According to manufacturers, up to four tracks can be covered and containers can be stored at the side of the rail tracks. They can be allocated from the yard to the landside operation and vice versa, if necessary. Including landside operation 2–3 RTGs and 4–5 TTUss (depending on the distance between berth and stacking area) are required per STS crane. They stack the container in blocks 1-over-4- to -7-high and 5 to 8 container rows plus 1 lane for container handover laneFigure 1. 4 RTG cranes and TTUs in the stacking yard, rail yard operation by RMGs System advantages †¢ low space requirement in the stacking area because of the high storage capacity in a small area (high stacking density). The containers can be stacked up to 8- high (i. e. 1-over-7-high)1 without spacing for traveling lanes between the rows. †¢ relatively high flexibility as the RTGs can be transported to other storage blocks Rail-Mounted Gantry Crane System These cranes are mounted on fixed rail tracks with a cantilever outside the portal of cranes (see Figure 1. ). Figure 1. 5 RMG cranes with TTUs System advantages †¢ RMGs generally stack higher and span wider, with up to 1-over-7-high and 12 containers wide †¢Stacking density of the yard is higher with RMG cranes and can exceed 1,000 TEU per hectare (stacking 4-high) Automated Guided Vehicles The horizontal transport of the containers will be performed with AGVs. (See Figure 1. 6). The handover positions for trucks are located at the top-end of the stacking blocks. The stacking of the containers is usually carried out by automated RMGs.The ShC is designed primarily to convey containers between the ships’s side and container stacks served by RMG cranes. As it is able to stack containers two high it will also be used for loading and unloading road trucks and rail cars. The shuttle carrier is an alternative aim at more efficiency to handle the container transport between the stacks and the quay cranes, and still maintain high density stacking by RTG or RMG yard cranes. The combination of our terminal equipment to be used will depend on if they are †¢ at the vessel, †¢ for transport tasks between quay and stacking yard ( or reverse) †¢ for container stacking, †¢ for transport from stacking yard to and from the landside operation area †¢ for landside operation itselfOperational areas: 1. The area between quay wall and container yard 2. container yard 3. terminal area of landside operations example the gate, parking, office buildings, customs facilities etc The container yard will be an intermediate storage facility meaning the containers will remain from a couple of hours to some weeks. There are different possibilities for the layout of our intermediate storage area. We may have stacking area which is compact, low ground area consuming stack without spacing known as block stack (see Figure 2. 1).In cases like these, yard gantry cranes will be used for the stacking of containers being delivered by terminal equipment of horizontal transport. An alternative is the linear stack (see Figure 2. 2) where the containers are stacked by Straddle Carriers (SC). This type of stacking will have spacing between the container rows and relatively wide terminal roads. Export and import containers will be segregated within the yard area and piled up to 4 containers high and pre-sorted for the various hinterland transport modes. Containers can be received at or released from the gate outside the working hrs shown above at no additional charge (except on public holidays), but prior notice should be given to the Port to ensure the Gate is staffed appropriately. A-3 Entry Passes Permanent entry passes are issued at the discretion of the Sr.Manager. Application forms are available at the main reception of the Container Terminal Administration Building. Permanent entry passes are valid for one year. Monthly & Daily entry passes are issued subject to proof of legitimate business in the terminal. Vehicle entry permits are selectively issued on providing vehicle registration and registration papers. A-4 General Cus toms Formalities The shipping line bears full responsibility for all Customs clearance formalities concerning their cargo. Section B – Landside Operations B-1 Terminal AccessARJ Container Terminal controls access of truckers to the terminal. A trucker is only allowed on the terminal after full identification of the trucker and registration of the terminal visit. Containers are only allowed onto the terminal on instruction of the shipping line that has to provide an acceptance notification to ARJ Gate Department before the container arrives at the gate. Information required will be as follows: †¢ Container ID and Booking No. †¢ Equipment Size/Type †¢ Outbound Vessel / Voyage and POD †¢ IMO / Reefer / OOG When delivering the container the trucker has to provide Container No. nd Booking No. to gate staff. All full containers will be gated in subject to clearance of Customs formalities by the shipping line. B-2 Exit Validation ARJ performs exit validation. Con tainers are only allowed to leave the terminal upon release instructions received from the shipping line, provided the customs department does not restrict the container from leaving the terminal. The shipping line must provide ARJ Gate Department with a hard copy of the release instruction. Information required will be as follows: †¢ Container ID †¢ Receiving Party Identification or Reference Number Date Restrictions if any Full containers will be allowed to depart the terminal only subject to completion of all customs formalities by the shipping line and full payment of port charges. B-3 Checking Activity at Gate For any containers entering or leaving the gate, the Port will perform a visual check and any deviations from provided data or anomalies are documented and reported to the shipping line. The check includes the following: †¢ Container ID †¢ Equipment size/type †¢ Visual damage (external) †¢ Visual damage (internal – empty containers onl y) †¢ Presence of SealIf any damage to a container is noticed at the gate, then a reference to this will be made on the gate ticket issued. Any further checking required e. g. Seal number, or further action like placing of seal or placard is chargeable as per Tariff. B-5 Customs Inspection In case ROP orders customs inspection of a container, shipping line should advise the port who will move the container to the customs inspection area and unstuff the cargo as per ROP requirement and subsequently restuff the cargo in the container, such operation to be charged as per Tariff.Section C – Vessel Operation Information on vessels calling ARJ to discharge or load containers is to be provided to ARJ planning department by the shipping line or its designated representatives. The Line shall nominate a focal point that can be reached 24 hrs a day by ARJ Planning and Operations Departments in case any issues concerning Vessel Planning / Operation need to be verified. C-1 Vessel Ar rival Notice The owner, ship’s agents or the master of the ship shall send the arrival notice to the Harbour Master 48 hrs before arrival to the Port.He should also inform the Harbour Master with the details of the Ship, its cargo, any hazardous cargo, cases of illness and any defects which affects the vessel manoeuvrability. C-1. 1 Documents Required †¢ Insurance cover for third party liabilities, wreck removal and oil pollution †¢ Ship’s registration certificate †¢ Port clearance certificate from last port of call †¢ ISPS Certificate †¢ Class Certificate C-1. 2 Establishing Communication The master of the ship shall establish communication with The Port Authority and request permission to enter the port limits, at least four hrs prior to the estimated time of arrival.The Port Authority will arrange the services of Pilotage, Tugs and Mooring Gang(s), and coordinate with ARJ Terminal Operations to have the gantry cranes and labour gangs ready. Normally cargo operations start upon lowering of the gangway from the vessel. C-1. 3 Pilotage Pilotage services are available round the clock. Activation time for marine services is 30 minutes. C- 2 Berth and Labour Planning Pro-forma vessel schedules and move counts declared by the l shipping lines form the basis for berth and stevedore / labour planning in the Quay Wall Schedule.Daily berth planning will also include: †¢ Initial vessel call information †¢ Detailed vessel call information for initial and pro-forma calls †¢ Availability of quay-wall space †¢ Vessel connections Based on this information ARJ Planning Department will prepare the day plan C-2. 1 Pro-forma Vessel Schedules Vessel string pro-forma berth windows are negotiated between the shipping line and ARJ. Berth windows are related to an estimated number of container lifts and the required day and time of the week for the vessel operation.Unless otherwise agreed, vessels will be planned for arrival and departure at pro-forma berth window. Vessels arriving within pro-forma always have priority over vessels out of pro-forma or incidental vessel calls. If it concerns vessels of the same shipping line only, this shipping line may set its own priorities, provided that it does not impact the berth windows of other Shipping lines. C-2. 2 Advance Schedules The shipping line will provide to ARJ Planning Department future projected schedules every week, from current date to 30 days in advance.Information required will be as follows: †¢ Vessel Name †¢ Inbound / Outbound Voyage †¢ ETA / ETD †¢ Service C-2. 3 Initial Vessel Call Information The shipping line is responsible for providing initial vessel call information at least 7 work-days prior to the estimated vessel arrival date to ARJ Planning Department. Information required will be as follows: †¢ Vessel Name †¢ Call Sign †¢ Inbound / Outbound Voyage †¢ ETA / ETD †¢ LOA †¢ Previous Por t of Call †¢ Next Port of Call †¢ Estimated Move Count †¢ Vessel Service †¢ Vessel Operator C-2. 4 Detailed Vessel Call InformationDetailed information is to be provided to ARJ Planning Department for line haul vessels at least 48 hrs and for all other vessels at least 24 hrs prior arrival at the terminal. Information required will be as follows: †¢ Vessel Name †¢ ETA †¢ Required ETD †¢ Expected Move Count, split as: – Total number of discharge / load moves – OOG discharge / load moves – Live reefer discharge / load moves – Empty container discharge / load moves – IMO class 1 & 7 discharge / load moves – Detailed information of any Break Bulk Cargo Upon receipt of this information, ARJ will undertake the final berth and labour planning.In case of required changes in the requested ETA / ETD, ARG Planning Department will contact the shipping line to create the best workable solution. The Port has a minim um billing per vessel call for loading/discharging of containers as per Tariff. Vessels are expected to use the Port's shore gantry cranes. Any movement or use of the vessel's gear while alongside is strictly subject to prior approval from the Port. C-2. 5 Communication on the ARJ Day Plan The Line will submit daily ETA update for their vessels latest at 10:00 hrs every day. ARJ will in turn revert with a Day Plan latest at 15:00 hrs.In order to provide flexibility to our customers, the Day Plan is always considered subject to change. Any agreements that are verbal in nature or those made after office hrs need to be confirmed in writing immediately on opening of the next working day. C-2. 7 Vessel Connections Connections other than those agreed to in the pro-forma schedule, have to form part of the Day Plan negotiations and these have to be announced to ARJ Planning Department preferably 48 hrs, but at least 24 hrs before ETA to ensure proper priority setting for the quay-wall. C-2. 8 Technical Information on the VesselFor vessels calling ARJ Container Terminal for the first time or in case of changes to the previously supplied vessel information the shipping line needs to supply ARJ Planning Department with technical information on the vessel at least 72 hrs before arrival. Technical information on the vessel consists of: †¢ Vessel Name †¢ Call Sign †¢ LOA †¢ Container Layout †¢ Lashing Plan †¢ Type of Twist Locks †¢ Type of Hatch Covers †¢ Mooring Restrictions (port / starboard side) †¢ Vessel Capacity in TEU †¢ Vessel Profile / NSD file (if available) †¢ Other peculiarities relevant to the Vessel StowageFurther details subject to planning or operational needs have to be provided upon request. C-2. 9 Notice of Readiness The Port Authority will issue the vessel with a ‘Notice of Readiness' at least 2 hrs prior to the estimated completion of cargo operations, and provided vessel confirms readiness to sail upon cargo completion The Port Authority will arrange to book Pilot, Tugs and unmooring gang(s). Section D – Load and Discharge Operation D-1 General D-1. 1 Gantry Crane Capacity Port provides shore-side gantry cranes with minimum capacity of 40 tons under the spreader and there are cranes with up to 65 tons capacity.D-1. 2 Lashing The Port Tariff for loading and discharging of containers includes the cost of lashing and unlashing of containers on board the vessel. Lashing equipment is to be provided by the shipping line. The Port will maintain safe housekeeping of lashing material at all times and handle all lashing gear in a controlled manner and in accordance with accepted safety standards. The Port will also handle discharging and loading of lashing material if required at no additional charge. D-1. 3 Hatch Cover Moves and Restows Hatch Cover moves and restows are chargeable as per tariff. D-1. 4 Use of Special EquipmentUse of special equipment for loading/unloading eg slings, frames etc is chargeable as per tariff on per lift basis. D-1. 5 Bay Planning and Stability Calculations The Port will carry out Bay Planning and unloading / sequence of containers in accordance with the information provided by the shipping line as part of its normal service. Container stow plans prepared by the Port are subject to the final confirmation by the Master of the vessel. The Port is responsible for providing information to the shipping line required for stability and lashing calculations, but the Port is not responsible for making these calculations.D-1. 6 Definition of Loading/Discharging of Containers Loading / discharging of containers is the handling by the Port of the containers between the stowage position onboard the vessel and the position in the container yard of the Port. No additional shiftings made based on any change in the information or additional information provided by the shipping line are included, and such additional shiftings made are cha rgeable as per tariff. Import / export containers pay truck loading / unloading charge as per tariff. D-1. 7 ReportingThe Port makes reports as per shipping line's required format and frequency to the operator of the vessel for all containers loaded/discharged and in case of vessels loading containers belonging to more than one shipping line, to each shipping line for their containers. D-1. 8 Storage Containers are stored in the Container Yard of the Port subject to the applicable Freetime and Container Storage rates as per Tariff. D-1. 9 Data Amendment Data Amendment charges as per Tariff apply in case the discharge and / or load lists are not provided in time to the Port, or in case there is any change to the information provided.Any Data Amendment that involves containers being shifted from one stack to another will incur shifting charges in addition as per Tariff. D-2 Discharge Operation D-2. 1 Vessel Profile Information The shipping line is responsible for communicating the dis charge, re-stow and remain-on-board instructions at least 24 hrs prior to the arrival of the vessel to ARJ Planning Department. For vessels with less than 24 hrs steaming time from the previous port, these details are to be provided as soon as information becomes available. The Bay-plan of the arriving vessel is to be sent via EDI message.D-2. 2 Discharge List Information The discharge list is to be provided to ARG Planning Department 24 hrs prior arrival for mother vessels and 18 hrs prior arrival for feeder vessels. Exceptions will be made on a case to case basis for vessels with lesser time as compared to these deadlines in which case load instructions have to be made available as soon as possible. D-2. 3 Checking Activity During Discharge (Tally) During the discharge process, ARJ will perform a visual check and any deviations from provided data or anomalies are documented and reported to the Line.This check also covers any restows. The check includes the following: †¢ Conta iner ID †¢ Equipment Size / Type †¢ Visual Damage †¢ Presence of seal (On request) Any further checking required eg Seal number, CSC plate validity etc or further action like placing of seal or placard is chargeable as per Tariff. D-2. 5 Short-landed Container When a container is reported short-landed, ARJ Planning Department will contact the Line. Information will be provided as follows: †¢ Container ID †¢ Seal Number †¢ Status (full / empty) †¢ Equipment Type / Size †¢ Stowage Position the container was found in †¢ IMO / Reefer information as far as possible †¢ Reasons for Over-landi ng The shipping line will investigate ownership / operator of the container and decide whether the container must be re-stowed or remain discharged.The shipping line will supply full container details to ARJ Planning Department and advise further action before vessel departure. D-3. 3 Re-Nomination of Cargo In the event of rollover of cargo for whatever reason, the Line is expected, within 12 hrs of vessel departure, to communicate to ARJ Planning Department, the name of the new vessel which will load the cargo. Every such ‘renomination' incurs a charge as per Tariff. D-3. 4 Pro-Forma Cargo Deadline In principle, all containers must be in the yard upon arrival of the vessel in order to maintain vessel schedule integrity and ensure efficient stevedore operations.The following will be taken into account: †¢ Vessel schedule reliability / integrity should not be affected †¢ Berth / Crane productivity should not be unduly impacted †¢ Line, Port and Customs requiremen ts The shipping line is responsible for ensuring that all cargo is available for loading prior vessel arrival. Same applies to cargo on hold or any other cargo released by the shipping line but not ready for loading due to any particular reason. D-3. 5 Checking Activity during Load (Tally) During the load process, ARJ will perform a visual check and any discrepancies or anomalies are documented and reported to the shipping line.This check includes restows. The check includes the following: †¢ Stowage Position †¢ Visual Damage †¢ Presence of Seal Any further checking required eg Seal number, CSC plate validity etc or further action like placing of seal or placard is chargeable as per Tariff. D-3. 6 Reporting ARJ Planning Department will update the shipping line with the ETC before and after start of vessel operation and advice the vessel and The Port Authority 2 hrs notice prior to vessel departure. Once vessel planning is completed ARJ will forward a BAPLIE to the ves sel.An updated BAPLIE will be delivered minimum 1/2 hour before completion of cargo operations. ARJ is able to provide the shipping line with EDI Load Confirmation Messages (COARRI) at frequencies agreed to with the shipping line. In addition to the EDI information a recap of the final load and a confirmed load list (CLL) will be sent to the Shipping line via E-mail earliest after vessel departure. In case of EDI failure ARJ will provide the shipping line with a Bay Plan of the load condition upon request.Any urgent or critical matters relating to discrepancies in reporting are to be addressed with the ARJ Planning Department D-3. 7 Short-Shipped Container When a container is reported as short-shipped, ARJ Planning Department will contact the shipping line. Information will be provided as follows: †¢ Container ID †¢ Vessel / Voyage †¢ Port of Discharge †¢ Stowage position stated for the container †¢ Reasons for Short-Shipping D-3. 8 Over-Shipped Container Wh en a container is reported as over-shipped, ARJ Planning Department will contact the shipping line.Information will be provided as follows: †¢ Container ID †¢ Vessel / Voyage †¢ Container Operator for the over-shipped container †¢ Status (full / empty) †¢ Category (export / transhipment) †¢ Stowage Position (if available) †¢ IMO Details †¢ Reefer Details †¢ Reasons for Over-Shipping D-4 Yard Inventory ARJ Planning Department will provide the shipping line with weekly Yard Inventory Reports for all laden and empty containers. In addition ARJ will also provide on a weekly basis a list of laden containers in the yard, which do not have a nominated on carrying vessel or POD.The shipping line will verify the missing details and revert with an update within 24 hrs of having received the input from ARJ. Any re-nomination or COD is chargeable as per Tariff. D-5 Vessel Bunkering, Repair, and Supply of Provision Vessel bunkering, repair and provisi oning activities have to be communicated to ARJ Planning Department at least 48 hrs before arrival of the vessel. These activities are only allowed after approval of ARJ and are subject to safety and security procedures issued by the Port.These activities should not delay the vessel stevedoring operation and must be completed within the operational working time of the vessel unless otherwise agreed. Only in exceptional cases may the stevedoring operations be stopped or the vessel port time extended because of these activities. Section E – Break Bulk and Over Dimensional Cargo E-1 Requirements The Shipping line is expected to provide information at least 48 hrs in advance of the vessel arrival to the ARJ Planning and Operations Department on any break-bulk activity on vessels that is planned at ARJThe following Information has to be provided: †¢ Arrival / Ongoing transportation via water / via land †¢ Handling by Container Gantry Crane / External Crane †¢ Piece count †¢ Measurements †¢ Cargo Description †¢ Weight †¢ Position on Vessel †¢ Complete description including sketches, diagrams, photographs etc in jpeg / bmp format †¢ Customs Approval Confirmation For over dimensional unitised cargo, the shipping line is expected to provide a complete Out of Gauge manifest as part of the documentation submitted for a vessel call.Undeclared, wrongly declared, poorly stowed or incorrectly packaged break-bulk or over dimensional cargo is subject to a fine as per Tariff. Port has the option of measuring and/or weighing the cargo to check the measurements and/or weight. The Port will provide warehouse for storing this cargo if required at no additional charge subject to availability. Any other equipment required for yard handling will be chargeable as per Tariff. Loading or Discharging and Quay Handling will be charged as per the applicable charges of the Tariff.Free time will apply as per the tariff for over dimensional c ontainers, and storage charges will apply as per the tariff for over dimensional containers based on the length. E-2 Restrictions Waterside handling restrictions are always subject to specific approval from ARG Planning and Operations Departments but approximately are as under: Dimensions Height Length Width Weight 10 m 18 m 6 m 65 MT Shipping lines are expected to taken to take approval from the terminal prior acceptance of bookings involving break-bulk and over dimensional cargoes.Section F – Direct Deliveries For exceptional cases there exists a possibility for accepting or delivering containers under the hook for direct loading / discharging. For safety reasons this activity will have to comply with ARJ Rules and Regulations. The Port should be advised at least 24 hrs before the arrival of the vessel at the Pilot Station of any planned direct delivery containers. The following information should be provided: †¢ Container ID †¢ Time of delivery †¢ Contents o f the container †¢ Hazardous Details (IMO Class, UN No. and Manifests as required Port of Salalah will inform the Line about the expected time of loading or discharge of the container. The requested direct delivery has to be confirmed to ARJ three (3) hrs before arrival of the vessel. Section G – Dangerous Cargo The shipping line bears the full responsibility for compliance to all rules and regulations governing the handling and transportation of Dangerous Cargo. Packing, labeling, declaration, stowage and documentation have to comply with the IMDG Rules and Regulations for Sea Containers as well as local laws and any directions given by local and Port Authorities.The Dangerous Cargo Manifest has to be provided to ARJ Planning Department at least 24 hrs before vessel arrival. The Line is responsible for content and sufficiency of the manifest. ARG will stow dangerous cargo container on the vessel as per instructions from the Line. Dangerous cargo containers pay additiona l charges for loading and discharging as per Tariff. Handling dangerous goods containers belonging to IMO classes 1 and 7 require special attention and permissions from the terminal and other competent authorities.Dangerous cargoes requiring special handling will be entitled to reduced free-time as compared to normal containers and will be subject to separate storage rates as per Tariff. Section H – Leakage / Spillage of Cargo Leakage of cargo contents from a container can be reported either by the shipping line on receiving information from the vessel or by ARJ staff while they are handling it in the terminal. On being made aware of a leakage, the shipping line will immediately advise its nominated surveyor to carry out a survey of the leaking container in conjunction with ARJ Health, Safety, Security ; Environment Department.On receiving the surveyor’s report, the shipping line will be responsible for taking necessary steps to arrange for re-packing of cargo through third party contractors or alternatively for cross-stuffing of cargoes, as per the advice received from the surveyor. Onward movement of such cargo from ARJ will be strictly subject to clearance from ARJ, that the leakage has been stopped and container is cargo and sea worthy for onward transport. Spillage of cargo will be solely on account of the shipping line as will a penalty charge applied as per tariff till corrective action is taken to stop the leakage.Section I – Container Freight Station Activities ARJ has capabilities for container cargo rework, cross stuffing and CFS activities. Arrangements can be made via the CFS Co-ordinator. Section J – Weighbridge Port has a weighbridge and shipping line can issue instructions for any container to be weighed at charges as per tariff. Section K – Miscellaneous Services Port can offer various services such as sweeping containers, fitting or removing tarpaulins, knocking down ends of flatbeds, bundling flatbed contai ners, applying or removing placards, fixing seals etc, all of which are chargeable as per tariff.Section L – Damage and Claims The Damage ; Claims Section of ARJ is responsible for dealing with damages caused to the shipping line’s equipment, its vessels or to port facilities, equipment or its personnel. L-3 Damage Caused by Third Parties If damage is caused to containers or vessels by parties other than ARJ, then ARJ will undertake repairs only at the specific request of the shipping line at its risk and account. L-4 Damage to Port Facilities/Equipment/PersonnelThe shipping line will be fully responsible for all costs and consequence arising due to any damage caused by it, to port facilities, equipment or personnel. Section M – Longstanding Cargo Consignments remaining in the port in excess of the following periods will be subject to auction. Any cargo, for which the respective Port and Customs charges have not been paid will be considered frustrated and may be auctioned and sold by ARJ after the following time periods: †¢ One Month – Refrigerated Containerized Cargo and other cargo considered perishable Three Months – All other Containerized Cargo Section N – Reefer Containers Live reefers will be plugged and unplugged as a standard activity in the stevedoring operations subject to availability of connections, at the temperature setting advised by the Line. Reefer monitoring and maintenance is carried out by the Container Service section of the Maintenance Services Department, and is chargeable as per tariff (charge includes electric supply). Monitoring of reefer containers is carried out at least every 8 hrs and any faults will be immediately reported to the Line.Export reefers can be pre-cooled if required and electric supply/monitoring charges commence from the time of plug-in. The Port can arrange PTI (Pre-Trip Inspection) of reefer containers and also can retrieve temperature data from the reefer data logge r, both activities chargeable as per Tariff. Section O – Port Safety and Security O-1 Rules ; Regulations ‘The Port of Salalah Rules ; Regulations’ is issued by the Port Authorities and applies to all users of the Port. Container Terminal Operational Guidelines Issued 1 stMarch 2007 30 O-2 International Ship and Port Security (ISPS) The Port of Salalah is certified as fully compliant with all requirements laid down under the International Ship and Port Facility Security Code (ISPS). All vessel operators are expected to fulfil requirements pertaining to their role as specified in the ISPS Code. O-2. 1 ISPS Measures by Port of Salalah Port of Salalah has designated a Port Facility Security Officer (PFSO) and a Deputy PFSO (DPFSO) as point of contact for all issues pertaining to ISPS rules and regulations for the Port of Salalah. O-2. 2 ISPS Requirements for the Line Shipping Agents must submit ISPS vessel certification, ETA of the vessel, Crew list, estimated port stay and last 10 ports of calls to the Port Control 48 hrs prior to vessel arrival.
